Two portals open the first-hire file. MassTaxConnect is not the unemployment account.
Massachusetts takes state income tax from paychecks. The Massachusetts Department of Revenue, often called DOR, collects that withholding. DUA collects state unemployment tax. That tax is often called SUTA, state unemployment tax, or SUI, state unemployment insurance. You open those two accounts on two systems. You still file them on two systems.
MassTaxConnect is DOR’s online tax portal. One MassTaxConnect file can open withholding and Paid Family and Medical Leave. PFML is Paid Family and Medical Leave. It is not the DUA unemployment account. DUA’s registration page opens unemployment on Unemployment Services for Employers. A MassTaxConnect login is not a DUA employer account number. A payroll login is not either account.
This is not New Jersey’s NJ-REG. New Jersey uses one start file for withholding and unemployment. Massachusetts does not. This is not Arizona’s Joint Tax Application. Arizona can start two agencies on one paper. Massachusetts starts DOR and DUA on two portals. Do not copy a one-file start onto Massachusetts.
When you owe unemployment: $1,500 in a quarter, or one person in 13 weeks
DUA’s contributions page is the regular-shop test. You need to contribute if you have one or more employees working on a permanent, temporary, or part-time basis at least one day a week for a minimum of 13 weeks during the calendar year. The weeks do not have to be consecutive. You also need to contribute if you pay $1,500 or more in wages in any quarter. One of those two tests is enough. M.G.L. c. 151A, § 8 is the unemployment statute DUA cites for that duty.
This is not California’s $100-in-a-quarter test. It is not Illinois’s 20-week test. It is not Colorado’s 20-week test. Massachusetts uses 13 weeks, not 20. Do not copy a 20-week clock onto Massachusetts. Do not copy Washington’s missing withholding account onto Massachusetts either. Massachusetts withholds state income tax from paychecks. The start files are not shared. The later portals are not shared.
Other tests sit on that DUA page. Agricultural shops use $40,000 in a quarter, or ten people one day a week for 20 weeks. Household work uses $1,000 in cash wages in a quarter. An out-of-state shop that pays $200 in Massachusetts wages in a quarter is an employer. This scorecard is the regular-business path.
Register unemployment on Unemployment Services for Employers. File the quarterly wage report by 3 p.m. on the last day of the following month.
DUA decides liability from the facts you send. DUA’s registration page says employers who pay wages for work done in Massachusetts must register. Go to the Unemployment Services for Employers homepage. Do not log in first. Select Register your Business. You will need the legal name, the federal EIN, the entity type, owner or officer Social Security numbers, the work done in Massachusetts, and any acquired-business facts. There is no 15-day California clock on that page. File when the facts show you are an employer. DUA emails next steps. Most registrations process the same day. A 501(c)(3) shop that chooses to reimburse benefits, a religious shop, or a government shop can sit in extra review.
After DUA issues the employer account number, hold that number and the contribution rate on the rate notice. Use that number on reports and payments. Do not substitute a federal EIN. DUA’s contributions page sets the 2026 new-employer rate at 2.42% for shops registered less than three years. New construction uses 6.08%. Established shops, registered three or more years, get an experience rate. DUA mails that Rate Notice by January 31. Use the rate on your notice, not a number from a software page. The first $15,000 of each employee’s wages in a calendar year is the wage base DUA uses for unemployment contributions and for the Employer Medical Assistance Contribution, called EMAC. Confirm that base on the live DUA page.
After the account exists, file the quarterly employment and wage detail report in Unemployment Services for Employers. DUA’s due-date list is April 30, July 31, October 31, and January 31, by 3 p.m. Late payments draw 12% interest until they are paid. A quarterly wage report is not the new-hire report. EMAC is the Employer Medical Assistance Contribution. It rides that same DUA wage file. DUA’s EMAC page exempts the first three years. It also exempts a quarter with fewer than six employees. Year four is 0.12%. Year five is 0.24%. Year six and after is 0.34 percent, on that same $15,000 wage base.
Register withholding on MassTaxConnect. Collect Form M-4. A federal W-4 is not enough.
Massachusetts withholds state income tax from paychecks. DOR’s withholding guide says you must withhold from Massachusetts residents for work in or outside the state, and from nonresidents for work in Massachusetts. Register on MassTaxConnect. The MassTaxConnect registration page needs the EIN, the start date, and owner or officer detail. A MassTaxConnect withholding number is not a DUA unemployment number. M.G.L. c. 62B, § 2 is the withholding statute.
Collect the federal Employee’s Withholding Allowance Certificate (Form W-4) and the Massachusetts Employee’s Withholding Exemption Certificate (Form M-4). DOR’s guide says new employees complete both. Massachusetts still uses exemptions. The federal W-4 does not. Calculate Massachusetts withholding from Form M-4 and Circular M, the Income Tax Withholding Tables. If the number of exemptions drops, the worker files a new M-4 within 10 days.
File the Tax Return of Income Taxes Withheld (Form M-941) on MassTaxConnect on the schedule DOR assigns from expected annual withholding. $100 or less files annually, due January 31. $101 to $1,200 files quarterly, due the last day of the following month. $1,201 to $25,000 files monthly, due the 15th of the following month, except March, June, September, and December, which use the last day of the following month. More than $25,000 still files a quarterly return and deposits when $500 or more has been withheld, within three business days after the 7th, 15th, 22nd, or last day of the month. New businesses file electronically. Patriot’s tax table also names the annual Form M-3. Confirm the live reconciliation form on MassTaxConnect.
New hire is a 14-day report. Independent contractors count. A quarterly wage report does not satisfy it.
The new-hire report is a list of who you just hired. It is not a box on the DUA wage report. DOR’s Report New Hires page requires the report within 14 days of the first day of work. Independent contractors count. M.G.L. c. 62E, § 2 is the notice statute. 830 CMR 62E.2.1 restates the 14-day clock. This is not the 20-day clock used in Colorado, Arizona, or Virginia. Do not copy a 20-day new-hire clock onto Massachusetts.
File on MassTaxConnect. Shops with 25 or more people must file online. Shops with fewer than 25 people may mail or fax the New Hire Reporting Form (Form NHR). A seasonal person or a return after 30 calendar days off the payroll is a new report. That 30-day return clock is not the 60-day rehire clock used in some other states. DOR’s withholding guide also names independent contractors who will earn $600 or more. A quarterly DUA wage report does not satisfy that 14-day clock.
Workplace injury insurance is due when the first employee starts
This is a first-hire policy for ordinary shops. It is not Washington’s state-fund monopoly. It is not Florida’s four-employee wait. It is not Virginia’s three-employee test. Massachusetts calls this workers’ compensation.
DIA’s insurance-requirements page is the agency rule. All employers operating in Massachusetts must carry coverage for their employees, and for themselves if they are an employee of the company. The rule applies no matter the number of hours or the number of employees. The only ordinary exception is a domestic worker who must work at least 16 hours a week. M.G.L. c. 152, § 25A is the insurance statute. Buy a policy from a licensed private carrier, join a self-insurance group, or qualify with DIA as self-insured. Ordinary first-hire shops do not self-insure. DIA does not sell insurance. DIA does not set the rates. The Workers’ Compensation Rating and Inspection Bureau of Massachusetts publishes those codes.
Members of an LLC, partners of an LLP, and sole proprietors are not required to cover themselves. Their employees still need a policy. A corporate officer who owns at least 25% may ask DIA for an exemption for that officer only. If you go bare, DIA’s Office of Investigations can issue a stop work order. The minimum fine is $100 a day, including weekends and holidays, until coverage starts and the fine is paid. An appeal raises that fine to $250 a day. A conviction can add up to one year in prison and a $1,500 fine. Uninsured shops can also lose public contracts for three years. A payroll login is not a policy.
PFML is a related first-hire duty. It is not the unemployment account.
PFML is Paid Family and Medical Leave. It is a separate program. It is not the DUA unemployment account. It is not EMAC. DOR’s PFML page says businesses with at least one Massachusetts employee must register on MassTaxConnect. DFML is the Department of Family and Medical Leave, the program office. DOR collects the money. File quarterly returns on MassTaxConnect. A DUA login is not a PFML account.
DFML’s 2026 rate page splits shops at 25 covered individuals. Shops with 25 or more send 0.88% of eligible wages. That split is a medical-leave share and a family-leave share. The shop may withhold up to 40% of the medical-leave share from pay, which is 0.28%, and must pay the remaining 0.42%. Shops with fewer than 25 covered individuals send 0.46% and do not owe the employer medical-leave share. Confirm the live rate on the DFML page before you treat a software table as current.
How Gusto and Patriot describe Massachusetts
Confirm the live withholding number on MassTaxConnect. Confirm the unemployment account and rate on Unemployment Services for Employers. Confirm PFML on MassTaxConnect. Confirm workplace injury insurance with a carrier or on DIA’s employer page.
Gusto’s Massachusetts help article says Middesk (Gusto’s business-verification company) may register state income-tax withholding and state unemployment insurance (SUI). In Massachusetts that Middesk order also includes PFML. Confirm the live numbers on MassTaxConnect and Unemployment Services for Employers. Confirm the rate on the DUA Rate Notice. The same article says Massachusetts may mail tax-account letters to the business, not to Middesk. It names DOR for withholding and PFML, and DUA for unemployment tax and EMAC. Read Gusto’s Massachusetts article. See Gusto on the directory.
Patriot’s tax table says Full Service files Massachusetts Unemployment Insurance (SUI or SUTA) on the quarterly DUA wage report. It also lists the COVID-19 Recovery Assessment, EMAC, the EMAC Supplement, the Workforce Training Fund, and both PFML shares on that quarterly path. It files Massachusetts income-tax withholding on Form M-941 and the annual Form M-3. Patriot’s registration article tells you to open withholding on MassTaxConnect and unemployment on the DUA portal. It does not claim Patriot opens those accounts. Use the rate on your DUA Rate Notice, not a number from a software page. Read Patriot’s article and Patriot’s registration article. See Patriot on the directory.
What still sits on the employer
- Decide that the $1,500-quarter test, or the 13-week test, has been met. Household, agricultural, and out-of-state shops use other tests, including the $200-quarter out-of-state test.
- Complete MassTaxConnect so DOR can open withholding and PFML. Complete Unemployment Services for Employers so DUA can open unemployment.
- Hold the DUA employer account number. Do not substitute a federal EIN for that number.
- Enter the contribution rate from the DUA Rate Notice, not a marketing figure. Confirm the $15,000 wage base on the live DUA page. New shops registered less than three years use 2.42% unless they are construction.
- File the quarterly employment and wage detail report in Unemployment Services for Employers by 3 p.m. on April 30, July 31, October 31, and January 31 after liability begins.
- Register withholding on MassTaxConnect. Collect Form W-4 and Form M-4. A federal W-4 is not the Massachusetts certificate. File Form M-941 on the schedule DOR assigns.
- File the Massachusetts new-hire report within 14 days of the first day, including independent contractors and a return after 30 days off the payroll. A quarterly DUA report does not satisfy that clock.
- Buy workplace injury insurance when the first employee starts. The 16-hour exception is for domestic work. DIA does not sell that policy. Payroll software does not issue that policy.
- Register PFML on MassTaxConnect when you have one Massachusetts employee. Do not treat PFML as the unemployment account. Shops with fewer than 25 covered individuals still send the worker share.
- Do not copy another state’s clock onto Massachusetts. Massachusetts does not share a start file. Massachusetts does not finish on one portal. Massachusetts does not use California’s $100-quarter test. Massachusetts does not use a 20-week unemployment test. Massachusetts does not use a 20-day new-hire clock. Massachusetts does not skip state paycheck withholding the way Washington does. Massachusetts does not use Florida’s four-employee workplace-injury wait. Massachusetts does not use Washington’s exclusive state fund.
